The Ministry of Trade and Integration of the Republic of Kazakhstan reported that, on the initiative of the Kazakhstan side, on November 3, 2020, the EAEU law was added with the possibility to suspend consideration of cases of violation of the General Competition Rules in cross-border markets. The relevant meetings of the Commission shall be held in person due to the confidentiality of the documents under consideration.
Due to movement restrictions of individuals in the context of the pandemic, business entities have lost the opportunity to personally participate in the consideration of the case and defend their rights. In this regard, they can suspend the proceedings by sending a corresponding letter to EEC.
At the the suggestion of Kazakhstan, EEC is currently considering amending the EAEU Treaty in terms of establishing the possibility of compensation for damage to an entity that has suffered due to violation of the General Competition Rules.
