The analytical material examines the practice of the French National Contact Point in handling specific instances under the OECD Guidelines for Multinational Enterprises on Responsible Business Conduct. The analysis is based on cases involving SHEIN, Air France, Veolia and Crédit Mutuel Equity, addressing labour rights, responsible supply chains, environmental and consumer risks, engagement with suppliers, as well as investor due diligence.
Particular
attention is paid to the different procedural outcomes of specific
instances, including the provision of good offices and mediation,
further examination where the parties do not reach an agreement, the
preparation of final statements and recommendations, as well as
closure of proceedings where a submission is withdrawn. The material
also separately examines the French NCP’s approaches to assessing
social audits, engaging with stakeholders, the use by companies of
available leverage, and cross-border coordination among NCPs from
different countries.
The
material demonstrates that the effectiveness of due diligence is
assessed not only by the existence of corporate policies, codes or
audits, but also by the quality of risk identification and
assessment, the involvement of affected stakeholders, the monitoring
of corrective measures, and the actual use of available leverage. It
also presents practical conclusions that may be used to further
improve the work of the Kazakhstan NCP, including in the handling of
cross-border specific instances, the assessment of due diligence
measures, and th.organisation of follow-up monitoring of the
implementation of recommendations.
